By purchasing and/or commissioning a product or piece of work from Kate Hawley Studios (“the Artist”) through Kate Hawley or via wwwkatehawleystudios.com, you (“the Client”) agree to the following:

 

GENERAL

Commissions and Original Works – wwwkatehawleystudios.com

 

1. All original work produced by the Artist is owned by the Client however, the Artist is the copyright owner (as that term is defined in the New Zealand Copyright Act 1994) in any piece of work. To the extent the work is commissioned in a legal jurisdiction outside New Zealand, the Client acknowledges that the Artist remains the holder of all moral rights and economic rights concerning the copyright of the work.

 

2. The Client is not commissioning the work for the purpose of resale, and will not reproduce or make additional copies of the work.

 

3. The Client understands and acknowledges that images of the work and the Artist engaged in the commission may be used in promotional material by the Artist.

4. The artwork will be flat packed or rolled to send when shipped. Shipping, packaging and VAT costs are additional to the Client.

 

5. Postal delivery is at the risk of the Client, and any damaged work cannot be refunded or reproduced.

 

Process and Payment

6. Payment of the full purchase price must be made prior to the Artist commencing work.

 

7. Payment may be made by any payment method described on the website, including AfterPay, as seen on the invoice, or as agreed by the Kate Hawley and client. To the extent payment is made in a currency other than New Zealand dollars, the Client is responsible for all currency conversion costs. The Client is also responsible for any bank charges associated with the payment.

 

8. Price is inclusive of any taxes but exclusive of any postage and delivery charges. Postage and delivery will be specific to the Client’s address and requirements.

Please note that your order will not be sent until payment has cleared.

Privacy

9. In completing and submitting an order for work, you will be providing us with personal information. If the information is not provided, your order may not be processed. Your information and any other personal information that you may provide to us will be held by the Artist on either the website or by electronic mail. Your details will not be sold or given to any other third parties. If you wish to access, correct or delete the information held by us, contact hello@katehawleystudios.com

 

Governing Law

10. These terms and conditions and the commission of the work are governed by New Zealand law.

 

Print Release Purchases

11. All products advertised on wwwkatehawleystudios.com are subject to availability.

12. All Prints are printed on-demand only. Allow for 14-20 working days for delivery. Estimated delivery times stated on wwwkatehawleystudios.com

 

Shipping

13. wwwkatehawleystudios.com will specify and estimate how many working days for your order to be dispatched, and will try and have the artwork/s shipped to you by that date.

14. wwwkatehawleystudios.com will not be liable for late delivery.

​

15. wwwkatehawleystudios.com takes no such responsibility for an incorrect or insufficient address. The artwork/s are at your risk as soon as they are dispatched from the studio to you.

16. A1 and AO artwork/s are rolled to send. Originals are all different sizes. Shipping is calculated once the commission is packed and ready to send.

17. Within New Zealand: Shipping costs include packing, overnight/signature required courier. RD1 (rural) addresses have an extra $3.20 charge to be applied. International: Shipping costs include packing and international air courier. Australia: Allow 14-20 working days. For the rest of the globe: Allow 20-30 working days. Originals are all different sizes. Shipping is calculated at checkout.

 

18. Once you have placed your order online, you will receive an order confirmation email with your purchase details and receipt of purchase

 

All Lecture Series class purchases will receive a calendar invite and Zoom link in NZT. This link cannot be passed on to others. 

 

Returns and Refunds

The following terms apply to the return of artwork/s:

19. There are no refunds or returns on limited edition print orders or Lecture Series purchases

20. If the original artwork or print is damaged and you want to return it, please contact wwwkatehawleystudios.com within 30 days of your order. You must pay all costs of returning the artwork/s to the New Zealand studio.

21. There are no refunds on the return of original works; however, a store credit of the same value will be issued to use on any future works or master classes at wwwkatehawleystudios.com within a 3-month period.

 

 

LECTURE SERIES CLASSES

Kate Hawley Lecture Series – Terms & Conditions

 

General Information

These terms and conditions apply to all participants registering for any Lecture Series Classes hosted by Kate Hawley Studios, including but not limited to online workshops, webinars, or live classes delivered via Zoom or other virtual platforms.

 

By registering for a masterclass, you agree to these terms.

Registration & Payment

1. Your place in the masterclass is only confirmed once full payment has been received.

2. Spaces are limited and offered on a first-come, first-served basis.

3. Payment is processed securely via Stripe or other approved platforms.

 

Cancellations & Refunds

1. Refunds are not available for cancellations made less than 7 days before the event.

2. If you are unable to attend, you may transfer your registration to another person by notifying us via email at least 24 hours before the session.

3. In the unlikely event that the session is cancelled or rescheduled by Kate Hawley Studios, you will be offered:

5. The option to transfer to a new date.

 

Participant Conduct

1. You agree to maintain respectful and constructive participation during the session.

2. Disruptive, abusive, or inappropriate behaviour will result in removal from the session without refund.

3. Recording the session (audio, video, or screen capture) is not permitted unless explicitly authorised.

 

Intellectual Property

1. All materials, slides, recordings, or visual content shared during the masterclass are the intellectual property of Kate Hawley Studios.

2. You may not copy, reproduce, or distribute any part of the content without prior written consent.

3. Sharing Zoom links or access credentials with non-registered individuals is prohibited.

Technology & Access

1. Participants are responsible for having a reliable internet connection and a functioning Zoom setup.

2. Kate Hawley Studios is not responsible for any participant’s technical issues (e.g., lost access, sound/video failure)

 

Recording & Replay

1. The session may be recorded for internal reference or replay access to registered participants.

2. By attending, you consent to the recording of the session, which may include your voice, image, or comments if you participate.

3. Any replay links provided are for private use only and may not be shared.

 

Privacy Policy

1. Your personal information will only be used to manage your registration and communicate about this or future events.

2. We will never sell or share your data with third parties.
